Terms of Use

These Terms of Use (hereinafter, “the Terms”) govern the use of the Wardrobe AI application (hereinafter, “the App”), distributed on the Apple App Store by Paulo Branco, Consultoria e Gestão Imobiliária, Unipessoal Lda (hereinafter, “we” or “us”). By installing, creating an account, or using the App, you acknowledge that you have read, understood, and fully accepted these Terms and the Privacy Policy.

1. Acceptance of Terms

Use of the App requires full and unreserved acceptance of these Terms. If you do not agree with any part of these Terms, you must not use the App. We reserve the right to update these Terms at any time; material changes will be communicated inside the App before taking effect.

2. Service description

Wardrobe AI is an iOS application that allows the user to:

• Upload photographs of their clothing items;
• Receive automatic classification (category, colour) by artificial intelligence;
• Receive outfit combination suggestions;
• Share results on social networks.

The App is provided “as is”, without warranties of continuous availability, error-free operation, or fitness for any particular purpose. We reserve the right to modify, suspend, or discontinue the service (in whole or in part) at any time, with reasonable notice when possible.

3. Minimum age and legal capacity

As stated above, only individuals aged 18 or older with full legal capacity to enter into binding contracts under applicable law may use the App. This restriction ensures full compliance across all jurisdictions where the App is made available and avoids processing data of minors. Age is validated at sign-up.

If an account is detected as having been created by a minor under 18, the account will be deleted immediately and all associated data erased per the Privacy Policy.

4. User account

• The user is responsible for keeping their credentials confidential.
• The user is responsible for all activity carried out from their account.
• Each person may have only one account. Duplicate accounts or accounts created on behalf of third parties may be deleted without notice.
• The user must immediately notify us at pal@drpal2028.me in case of unauthorised account use.

5. User content

The user retains all ownership rights in the photographs and other content they upload to the App. By using the App, you grant us a non-exclusive, worldwide, royalty-free, revocable licence to store, process, and display such content solely for the purpose of providing the service.

This licence terminates automatically when you delete the content or your account. We do not use, sell, or transfer content to third parties for any other purpose.

The user agrees not to upload:

• Content that is illegal, defamatory, obscene, violent, exploitative of minors, or that infringes the rights of third parties;
• Content containing malware, viruses, or malicious code;
• Images depicting third parties without their consent;
• Content that infringes intellectual property rights, trademarks, or copyrights.

We reserve the right to delete, without prior notice, content that violates these Terms or applicable law, and to suspend or delete the accounts of repeat offenders.

6. Intellectual property

The App, including its name, logo, design, source code, interfaces, texts, and images, is the exclusive property of Paulo Branco, Consultoria e Gestão Imobiliária, Unipessoal Lda and its licensors, protected by copyright, trademark, and applicable law. Nothing in these Terms transfers any intellectual property rights in the App to the user.

7. Limitation of liability

To the maximum extent permitted by applicable law:

• The App is provided “as is” and “as available”, without warranties of any kind, express or implied.
• We do not warrant that the App will be error-free, uninterrupted, or that the results generated by the artificial intelligence will be accurate, complete, or fit for any specific purpose.
• We are not liable for indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the App.
• Our total aggregate liability to the user, in any circumstance, is limited to the amount paid by the user to use the App in the 12 months preceding the event giving rise to the liability (or, the App being free, the symbolic amount of €1).

Nothing in these Terms excludes or limits liability for wilful misconduct, gross negligence, death, personal injury, or any other liability that cannot be excluded by law.

8. Acceptable use

The user agrees not to:

• Use the App for illegal or unauthorised purposes;
• Attempt to circumvent security, authentication, or rate-limiting mechanisms;
• Reverse-engineer, decompile, or disassemble the App;
• Overload the infrastructure with automated requests, scrapers, or bots;
• Use the App to create competing products or to extract, replicate, or aggregate data in violation of these Terms.

9. Suspension and termination

We may suspend or terminate any user's account, with or without notice, in case of breach of these Terms, fraud, abusive behaviour, court order, or legal requirements. The user may delete their account at any time through the App settings or by contacting us at pal@drpal2028.me.

Upon deletion, all associated personal data is erased per the Privacy Policy.

10. Governing law and jurisdiction

These Terms are governed by Portuguese law. Any dispute arising from their interpretation or enforcement shall be subject to the District Court of Porto, Portugal, with express waiver of any other forum, except where mandatory consumer-protection legislation grants different jurisdiction.

EU-resident users may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

11. Final provisions

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in force.
• Failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
• These Terms, together with the Privacy Policy, constitute the entire agreement between the parties regarding the App.
